Rural King Rewards Loyalty Program Terms and Conditions

Rural King Rewards Loyalty Program is a voluntary loyalty program. By joining or using Rural King Rewards You (“Member”) hereby acknowledge and agree to these Terms and Conditions located at https://www.ruralking.com/loyalty-rewards-terms-conditions as well as thePrivacy Policy located at https://www.ruralking.com/privacy-policy which is incorporated herein by reference.

RK Holdings, LLP, (“Rural King”) in its sole and absolute discretion, reserves the right to terminate, modify, add, end, or delete any of these Reward Terms, this Program or any subprograms, benefits, special offers or rewards, in whole or in part, at any time, including during the Program, with or without notice. Any changes or modifications will be effective immediately upon posting the revisions to https://www.ruralking.com/rewards , and You waive any right You may have to receive specific notice of such changes or modifications.

In the Rural King Rewards Terms, these words are defined as follows:

Rural King Rewardsis a loyalty program offered by RK Holdings, LLP d/b/a Rural King.

Rural King Rewards Termsare these terms and conditions that govern the Rural King Rewards program.

Rural King Rewards Earningsare rewards which can be earned by Rural King Rewards Members by making purchases on qualified products.

I. Membership Eligibility

The Program is open to U.S. residents 18 years or older at the time of enrollment who are not Resellers. Resellers are defined as a company or individual that purchases Rural King’s goods with the intention of selling them to the public rather than using them.

Ø The Program is void where prohibited by law.

Ø The Program requires a valid email address and phone number.

Ø No purchase is required to enroll in the Program.

Ø Employees of RK Holdings, LLP or its affiliates may participate.

II. Receiving Rural King Rewards Benefits

In order to receive, earn and redeem all the Rural King Rewards benefits, You need to provide Your first and last name, address, and a valid email address, and phone number in Your Rural King account at checkout.

When You make a purchase in Rural King stores, You can identify Yourself as a Rural King Rewards member at checkout by entering Your mobile telephone number on the POS system or by simply informing the cashier. If You purchase items in violation of these terms, Rural King reserves the right to not award Rural King Rewards Earnings or to deduct improperly awarded Rural King Rewards, and/or to terminate Your account.

III. Qualifying Purchases. Purchases made will count towards the calculation as defined below. Qualifying Purchases include all transactions unless expressly excluded. See Rural King Rewards Exclusions below.

Opting out of Rural King Rewards and forfeiture of Rural King Rewards Benefits.

If You no longer wish to be a Rural King Rewards Member, You can opt out of Rural King Rewards by emailing Customer Service at [email protected] or calling 1-800-561-1752.

If You opt out of Rural King Rewards, any accumulated Rural King Rewards Earnings rewards will be deleted, and You may not have access to other Rural King Rewards benefits.

If You enroll or participate in Rural King Rewards using an invalid telephone number, such as a toll-free number, international telephone number, invalid area code or invalid exchange, Rural King reserves the right to delete Rural King Rewards Earnings rewards, and any other Rural King Rewards benefit associated with the invalid telephone number. Rural King will not reinstate any deleted Rural King Rewards Earnings rewards or other Rural King Rewards benefits if a valid telephone number is subsequently provided.

Rural King reserves the right to change, limit, modify or terminate Rural King Rewards, the Rural King Rewards Terms, and/or Your membership, for any reason, at any time, with or without notice.

IV. Reward Issuance

Ø Reward Ratio. Members will receive 1 point for every $1 spent. Rewards will only be issued after the member hits 500 total points.

Ø Timeliness of Reward. Rewards will be automatically issued within 24 hours.

Ø Reward Balance. Members may check their account balance at the checkout register by asking a Rural King team member to review their loyalty account balance or online at https://www.ruralking.com/loyalty-guest.

Ø Reward Expiration. Unless noted otherwise on the Reward, Rewards will expire 60 days from the issuance date, after which the Rewards will no longer be available. The issuance date is the date the reward is posted to the member account. These expiration dates may vary by Reward. Any Reward not used before the specified expiration date will be forfeited by the Member.

V. Reward Redemption

Rewards can be redeemed for eligible purchases, less any exclusions defined via the Terms, or the Terms associated with a specific Reward, Offer, or other Benefit.

Ø In Store Redemptions. For in-store redemptions of the Reward, the Member will provide their telephone number during checkout process. At that time, the cashier will have access to available Rewards and the account balance. The Member will then have the discretion to redeem the Reward and apply it towards an eligible purchase.

Ø Online Redemptions. For online redemptions of the Reward, the Member must log into their Rural King Loyalty Rewards account and initiate the order. During the online check-out process, the Member will select the Reward amount to be applied to the order. Orders placed outside the rewards account or in ‘guest checkout’ are not eligible for redemption.

Ø Earned Rewards. The Rewards acquired through qualifying purchases may be split into multiple transactions. Members can elect to redeem all or only a portion of their Rural King Rewards Earnings. If Member wishes to redeem a partial award, Member must notify cashier prior to processing the payment at checkout. If the Member fails to do so, the entire award may be applied. In such an event, no additional reward or replacement reward will be provided. It is the sole responsibility of the Member to outline how the award should be applied, whether entirely or partially. If Member fails to specify, Rural King, in its sole discretion, will apply the entirety of any available reward.

Ø Denominations. Rewards may be issued in various denominations. The default Reward is $5.

Ø Gift Cards or Cash Equivalent. Rewards cannot be credited to an account, redeemed for cash or cash equivalent, applied to past purchases, or used for purchasing gift cards.

Ø Frequency of Redemption. Rewards may only be redeemed once and are not transferrable to other parties.

Ø Offer Conjunction. Rewards may be redeemed in conjunction with other Rural King offers, unless explicitly stated herein, or in the terms of a specific Reward or offer. Rural King reserves the right to refuse any offers made in conjunction with subsequent offers, as it deems necessary.

VI. Rural King Rewards Exclusions

Only purchases made at Rural King stores are eligible to earn Rural King Rewards Earnings rewards.

Rural King Rewards Earnings rewards are not earned on the following:

Ø Tractor purchases;

Ø Purchases made at some partner businesses, including in-store clinics such as Country Critters;

Ø Purchases made from Rural King through 3rd party sites;

Ø Purchases of Rural King Gift Cards; and Visa, American Express and Mastercard gift/prepaid cards;

Ø Taxes, bottle deposits, shipping, delivery, handling and all other fees or charges;

Ø Prior purchases;

Ø Online purchases including, but not limited to, rkguns.com; or

Ø Where otherwise prohibited by law.

Other restrictions may apply to earning Rural King Rewards Earnings rewards. Rural King reserves the right to modify these terms at any time.

Rural King Rewards Earnings rewards cannot be redeemed for the following:

Ø Purchases made at Country Critters or other businesses on Rural King property;

Ø Purchases through 3rd party sites;

Ø Purchases of Rural King Gift Cards; specialty gift cards; and Visa, American Express and Mastercard gift cards/prepaid cards;

Ø Taxes, bottle deposits, shipping, delivery, handling and all other fees or charges; balance, debit card cash withdrawals at checkout and payments for insufficient funds;

Ø Prior purchases;

Ø Where otherwise prohibited by law; or

ØOnline purchases from affiliate websites including Rkguns.com or rktractors.com.

Other restrictions may apply to the issuance or redeeming Rural King Rewards Earnings. Rural King reserves the right to modify these terms at any time.

VII. Returns. If items that earned Rural King Rewards Earnings are returned, the associated Rural King Rewards Earnings may be removed from your Rural King Rewards Earnings balance.

In the event You have already redeemed Your Rural King Rewards Earnings, Rural King reserves the right to subtract any points from Your Rural King Rewards balance and/or offset any award monies applied to the purchase which was returned. For example, if a Member purchases an item for $25.00, applies a $5.00 reward, but returns the item later, the Member may only receive a refund of $20.00. In such an event, you will not have redeemable Rural King Rewards Earnings until the balance is greater than zero.

VIII. Member Offers and Benefits. Rural King Rewards Offers are only valid in store, unless explicitly noted otherwise. No more than one manufacturer coupon (paper or digital), one Rural King coupon and one Rural King Rewards Offer can be combined on any item. Rural King Rewards Offers cannot be applied with a price match. Rural King Rewards Offers will be void if copied, scanned, altered, transferred, purchased, sold, or prohibited by law. All Rural King Rewards Offers may not be available at all stores due to product availability. The Rural King Rewards Offer value may not exceed the value of the item purchased. All Rural King Rewards Offers will have no cash value.

At the sole and absolute discretion of Rural King, additional bonus offer(s) or incentive opportunities may be available to Rural King Rewards members in some or all markets. The communication about any bonus offer opportunity will include additional terms and conditions, if applicable. IX. Modifications. Rural King has the right to remove or cancel offers and/or awards from Rural King Rewards Balance, at any time, and for any reason, without notice. For Rural King Rewards Offers with a percentage discount, the actual dollar value may vary based on the item price at each store. Pricing, promotions, and availability of items appearing in Rural King Rewards Offers may vary by store location. Not all items are available in all markets. Descriptive, typographic and photographic errors are subject to correction and Rural King shall have no liability of any kind for such errors. The numbers shown for total savings at the individual level for Rural King Rewards Offers are specific to each account and do not reflect combined totals or the impact of any returns or exchanges that may be associated with those transactions.

X. Regulations. All Rural King Rewards Offers are subject to local and state laws and regulations. Such offers may be restricted or void in some locations. Rural King shall have no liability for the impact such laws or regulations may have on the ability to utilize such offers. All descriptions, images, references, features, content, specifications, products, and prices described or depicted on Rural King Rewards are subject to change at any time without notice.

XI. Data Usage. By agreeing to these terms, Member agrees that Rural King, it’s affiliates, subsidiaries, and sister companies may collect and use technical data and related information that is gathered periodically to facilitate the provision of Rural King Rewards Program, product support or updates, sales, advertising, customer satisfaction, and purchase activity. Rural King may collect, use, transfer, and/or disclose such information for any purpose, if it is in a form that does not include confidential information. The Rural King Privacy Policy is expressly incorporated herein and may be found at https://www.ruralking.com/privacy-policy. As noted above, Members wishing to opt out of Rural King Rewards may do so by calling Customer Service at 1-800-561-1752.

XII. Communications. By creating Your Rural King Rewards Account, You agree and opt in to receive general and targeted advertising, marketing materials, special offers and rewards, and other communications, including mail, email, SMS, other computer electronic messaging or other means, from Rural King, ruralking.com, rkguns.com, rktractors.com, and/or the Rural King Rewards Program. Rural King may collect customer data and traffic information for the purposes of support, improvements, and/or analytical analysis. As such, by participating You hereby consent to our collection, use, and disclosure of such information. Members may also unsubscribe from Rural King advertising emails by visiting https://www.ruralking.com/email-unsubscribe.

XIII. Deactivation. Rural King reserves the right in its sole and absolute discretion to remove or delete any or all material from Your Account at any time. Rural King may also deactivate Your Account entirely, for any reason, and in its sole discretion. By participating in Rural King Rewards, You acknowledge and agree that, except to the extent required by law, Rural King has no obligation to make a copy, electronic or otherwise of Rural King Rewards or Tracked Purchases available to You at any time, including, without limitation, upon deactivation of Your account for any reason.

Any abuse by a Member of the Program’s privileges, any failure by a Member to follow these Terms, or any misrepresentation by a Member may subject the Member to expulsion from the Program, including forfeiture of all accumulated points and any corresponding dollar value.

An account shall be deemed inactive after a period of 365 days of inactivity. Once an account is deemed to be inactive, or disqualified, for whatever reason, all points accumulated in said Member Account may, in Rural King’s sole discretion, be deemed to have been forfeited by said Member, with or without notice. In the event of inactivity, Member profile may be accessible, but any points and/or rewards will be forfeited.

XIV. Governing Law and Dispute Resolution. You agree that this agreement and Your participation in the Rural King Rewards Program and any subprogram will be governed by the laws of the state of Illinois. By participating in the Rural King Rewards or any subprogram, You consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies in Central District of Illinois, in all disputes (i) arising out of, relating to or concerning the Rural King Rewards or any subprogram of the Rural King Rewards Program, these Reward Terms, any subprogram terms and Your participation therein; (ii) in which the Reward Terms or any subprogram terms are an issue or a material fact; or (iii) in which the Reward Terms or any subprogram terms are referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization.

XV. Waiver of Rights: You agree to waive, to the fullest extent allowed by applicable law, any claims for special, consequential, punitive or exemplary damages and any right to pursue claims on a class or consolidated basis or in a representative capacity, which relate in any way to the Rural King Rewards or any subprogram or the Rural King Rewards Terms or any subprogram terms. YOU FURTHER IRREVOCABLY WAIVE ANY AND ALL RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING, ARISING OUT OF, OR RELATED TO, THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREBY.

XVI. Warranty. RURAL KING’s, ITS PARENT, SUBSIDIARIES, OR AFFILIATES, MAKE NO EXPRESS OR IMPLIED REPRESENTATION OF WARRANTY AS TO ANY BENEFITS AND WILL NOT BE LIABLE FOR INJURY, DAMAGE, LOSS, OR EXPENSE RESULTING FROM THE USE OR ACCEPTANCE OF ANY PART OF THE LOYALTY PROGRAM, PRODUCTS PURCHASED IN RELATION TO THE PROGRAM, OR ANY SUBPROGRAM, THEREOF. MEMBERS ACKNOWLEDGE AND AGREE THAT RURAL KING HAS NOT MADE AND IS NOT IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE AND FITNESS FOR A PARTICULAR PURPOSE).

XVII. Indemnity. RURAL KING, ITS PARENT, SUBSIDIARIES, OR AFFILIATES, SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, INJURY, LOSS, OR DAMAGE OF ANY KIND, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY OR DEATH, PROPERTY DAMAGE, BREACH OF CONTRACT, OR OTHERWISE, WHICH RESULTS FROM THE MEMBER’S AFFILIATION OR INVOLVEMENT IN THIS PROGRAM, MEMBERS PRESENCE ON THE PROPERTY TO PARTICIPATE IN THE PROGRAM, OR THE PRODUCTS PURCHASED AS A RESULT. THIS INDEMNITY AND LIMITATION OF LIABILITY IS COMPREHENSIVE AND SHALL APPLY TO ALL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; NEGLIGENCE, GROSS NEGLGENCE, BREACH OF CONTRACT, LOSS OF DATA; SECURITY BREACH; LOSS OF SOURCE DATA, INCOME OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES.
